Are merger and acquisition objection lawsuits coming to a close?

mergeersOver 90% of all M&A cases result in a securities lawsuit, and the Delaware Court of Chancery seems to be giving more scrutiny towards these cases. Most of these suits in the past have settled upon agreement but recently the merit of the suits has drawn serious attention. Recently, there have been record-breaking mergers, like the Dell and EMC acquisition,  that could result in large settlements depending on how the courts determine to handle these suits.
Recent decisions in cases for Riverbed Technologies and HP’s acquisition of Aruba networks are examples of the scrutiny the Delaware Courts are placing on this matter. There is still an extensive list of pending merger objection litigation in Delaware, but as the suits progress, we expect more clarity around the requirements for bringing actions.
