Class action legal proceedings are now available in Thailand

The National Legislative Assembly of Thailand has passed a bill to allow class action legal proceedings, which has received royal endorsement and will be implemented in December 2015. This is a remarkable action in the Thai court system because prior to this bill, class actions were not available.  The legislation shares its similarities with the United States, but consists of notable changes in substance and procedure.Class action proceedings available in Thailand

In the bill, a class is defined by a group of persons who have the same interests and rights related to a breach of contract laws including environmental, consumer protection, labor, securities and stock exchange, as well as trade competition. The Court has full power to allow, define what constitutes a class, and terminate a class action. Class members may opt-out to pursue individual claims. A plaintiff has the power to proceed on behalf of all members with execution of the judgement. The establishment of class actions in Thailand are expected to increase the efficiency of the court by combining a large number of individual claims into one suit.
